The App will function to provide the Service only with proper activation credentials issued by Vision To Learn. It should not be downloaded by anyone other than Vision To Learn contractors and employees who are directed to do so, and will not provide the Service of data access to anyone without Vision To Learn Credentials.
If you are a patient, or the parent or guardian of a patient, who has received eye care from Vision To Learn, you cannot access any information or data regarding yourself or the child in your care through the App. If you need information or have questions about the care you or the child has received, please contact Vision To Learn at [email protected] or call (800) 485-9196.
COLLECTION AND USE OF YOUR INFORMATION
Whenever you use our Service, in a case of an error in the App we collect data and information (through third party products) on your device called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.
We may employ third-party companies and individuals due to the following reasons:
• To facilitate our Service;
• To provide the Service on our behalf;
• To perform Service-related services; or
• To assist us in analyzing how our Service is used.
These third parties have access to your PI. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.
We value your trust in providing us your PI, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.
YOUR USES OF PI AND PHI
As a member of the Vision To Learn team, you have a primary responsibility to protect the PI and PHI that you enter into or can access through the App. By opening the App and using the Service, you affirm your agreement to maintain the confidentiality of all PI to which you have access and to comply with HIPAA with respect to all PHI to which you have access. If you have any question regarding your responsibilities, you are to contact your supervisor immediately.
HIPAA Notice of Privacy Practices
It is Vision To Learn’s policy to comply fully with HIPAA’s privacy requirements and to use and disclose PHI only as permitted under HIPAA.
I. Use of PHI
The term “use” is defined as the sharing, employment, application, utilization, examination, or analysis of individually identifiable health information by any person who already has access to such information, granted under the intended user rights in the App.
Vision To Learn employees and contractors who are assigned to performing Eye Care services involving the use of the Service on the App will only have access to the minimum amount of PHI necessary to fulfill their responsibilities, and will not download or copy any PHI other than in performance of their responsibilities. The App does not store historical PHI.
II. Disclosure of PHI
For information that is PHI, disclosure means any release, transfer, provision of access to or divulging in any other manner of individually identifiable health information to persons not already having access to such information, granted under the intended user rights in the App. You agree not to do so. The App does not contain, nor can it provide, historical information.
Policies on Individual Rights to Information
HIPAA gives individuals the right to access and obtain copies of their PHI as maintained in designated record sets. HIPAA also provides that individuals may request to have their PHI amended. Individuals may also request restrictions on the use and disclosure of their PHI, and Vision To Learn will adhere to such requests. The Mobile App does not provide the ability to amend such requests.
